JOE then wrote out a check for $1,000.00 and told BOB he would pay him the rest in a week. BOB took the check from JOE and cashed it. Later in the week, JOE showed up to pay BOB the rest of the purchase price and to pick up the car, BUT, BOB told JOE that he, BOB, had changed his mind and would not sell JOE the car.
JOE now sues BOB claiming that they had a Contract and that the Court should force BOB to sell him the car. BOB states: "There never was a Contract. Nothing was in writing and, I am also entitled to change my mind."
