John runs a car dealership called "Brisbane Cars" (BC) which buys and sells luxury cars. John places a sign at the front of his business which reads: "We sell the best luxury cars in Australia, and we sell the most fuel-efficient luxury cars in Brisbane!"

Jenny runs a competing car dealership called "Top Cars" (TC). Jenny hires a private investigator who discovers that BC sells cars, which have very poor fuel efficiency ratings compared to cars sold at most other luxury car dealerships in Brisbane.

Jenny emails John stating that John should take down the sign because BC does not sell the most fuel-efficient luxury cars in Brisbane. Despite the email, the sign still remained at the front of John's business.

John replies to Jenny stating that even if BC does not sell the most fuel-efficient luxury cars in Brisbane, there is nothing wrong with the sign as John did not intend to provide inaccurate information.

Jenny wants to take legal action against John. Jenny believes that BC does not sell the best luxury cars in Australia nor the most fuel-efficient luxury cars in Brisbane.

There is no evidence that any customer actually believed in, or relied upon, the claims made in John's sign.
