Josh runs a small company and had a contract with Al Macintosh to supply computer services for Josh's business at $200 a month. The contract was to expire at the end of December 2020. Before the expiry of the contract Josh said he would pay $400 a month for the next six months so that Al Macintosh could upgrade the cloud services for extra storage of data and documents.

Al Macintosh continued to perform the maintenance work on the computer system but failed to upgrade the cloud services within the six months. He invoiced Josh at $400 a month over that period of time.

Al Macintosh says there was no agreement as Josh did not specify which system he wanted.
