Joshua worked for Neenah Paper at a book bindery. He worked with a partner on a machine which cut pages to fit the specified book size. This machine had massive motorized blades which posed a serious risk of hand and arm injury. One member of a team would operate the blade while the second, the feeder, guided the paper supply. Joshua was a feeder. Both Joshua and his cutter had seen operators be injured by this machine and were extremely cautious in its operation. The manufacturer of the machine, Macro, had continued to monitor the owners of these machines and upgrade their safety features. Since Neenah Paper bought the cutting machine, Macro had designed a system whereby each team member had to pull a lever simultaneously to release the cutting blade. This improvement had virtually eliminated accidents caused by errors in judgment of the blade operator as to whether the feeder was in a totally safe position. Macro had informed Neenah Paper of the need to retrofit the machine for this safety improvement. The cost to Neenah would be relatively small, but Neenah Paper bad not installed the retrofit package.
