Juan, a citizen of The United States, applies for a job with ABC working on the assembly line. The job qualifications do not require a high school diploma or any special verbal or writing skills. The job does require certain mechanical skills which Juan clearly can show he possesses. Juan is refused employment with ABC. ABC's supervisor claims he did poorly in his interview as he did not appear to have good communication skills. The supervisor further claims his answers to written questions were difficult to understand because of his poor grasp of the English language.
