Jubilee Jet had a policy that its senior pilots had a mandatory 60 years of age retirement. These pilots are considered corporate pilots and are not subject to the same Federal Aviation Administration (FAA) regulations as pilots employed by airlines such as Delta and United. At the time in question here, the FAA required commercial pilots to retire at 60 years of age. That has sense been revised by the Fair Treatment for Experienced Pilots Act in 2007 which states commercial pilots can fly until they are 65. The pilots forced to retire at age 60 and shortly before the commercial pilots regulation by the FAA, chose to sue Jubilee Jet for age discrimination. How will the court decide? Why?
