Robert s very keen to sell the property and tells Sam that if he buys it, Robert will leave all the gardening equipment in the shed of the property including a ride on over valued at about $10,000. Sam is happy with this and a contract is drawn up and both Robert and Sam sign it. There is no mention of the gardening equipment in the written and signed contract. When Sam moves in to the property he realizes Robert did not leave the gardening equipment as agreed. Robert says he is not obliged to as it was not in the written contract. Sam says it is a collateral warranty, which forms a collateral contract. Advise Sam Q2 Akua's house is robbed in Farmers day and the thieves steal many items, including her Great grandfather's World War 1 medals. Ann is distraught and puts an advertisement in the local newspaper and offers a reward of $1,000 for whoever finds and returns the precious medals. Donny is a cleaner at the local shopping center.As he was emptying the bins, the medals fell out of the rubbish. Jim then sold the corrola to Greg. On the 14th August Esi telephoned Jim and said she accepted Jim's offer to sell the corrola for Ghe30,000. Jim said bad luck, already sold. Esi said that Jim had promised to keep the offer open until the 15th August and therefore had breached his contractual obligations by selling it to Greg. Advise Jim. Q4. Costa is building a waterfront apartment complex with 15apartments. Costahires Jack as a subcontractor, to build all the kitchens and cabinets required for the apartment complex. The terms of the agreement are that jack has tocomplete the job within three months and will be paid $200,000. Two monthsinto the job, Jack tells Costa tat he is running behind time and will not Inish within the three months. Costa tells Jack that if he Inishes the job within three months Costa will pay him an extra $50,000. Jack Inishes the job in time and then Costa refuses to pay him the extra $50,000 as Costa says Jack is performing as existing contractual duty and provided no consideration. Is Jack entitled to claim $50,000 from Costa
