On July 15, 2018 (while at Santa South), Kris decides to visit the local sporting goods store ("Texas Ye-haw Sporting Goods") to purchase a hammock. While at the store, Kris speaks with the store manager (Butch "Bring em Pain" Smith) and tells him that he would like to buy a hammock suitable for someone like himself to sleep in. Kris makes it clear that it is up to the manager to select a suitable hammock. The manager selects a hammock that is perfectly suitable for a normally-sized person but that cannot support someone of Kris' weight. Relying on the manager's recommendation, Kris buys the hammock. On July 17, 2018, Kris is injured when the hammock collapses because it cannot bear his weight. Kris is rushed to the hospital where he receives excellent medical care. After two-days of inpatient treatment, Kris is released from the hospital and sent home. On July 30, 2018, Kris writes a letter to the store which, in relevant part, reads as follows: "You dirty rats! You sold me a bad hammock and now I am suffering from a broken arm, two cracked ribs and a dislocated shoulder. You better take care of this problem - OR ELSE!" After receiving the letter, the store manager is so upset by the tone of it that he throws it in the wastebasket, saying "I will not respond to threats!" On September 15, 2018, Kris sues the store claiming that it breached the implied warranty of fitness. Can Kris recover? Assume that the store is a merchant with respect to hammocks.
