Per section 5 of its Pharmacy Act, 1982 it is an offence for anybody to offer to sell aspirin without the prerequisite supervision of a qualified pharmacist. Alien Pharmacy, located in Kwaluland however operates a self-service shop where a customer can walk into the shop and pick any pharmaceutical product, including aspirin and then go to the till to pay where a qualified pharmacist is stationed who can prevent a customer from purchasing the aspirin, if need be. The Kwaluland Pharmaceutical Association is alleging that Alien Pharmacy has infringed on Section 5 of the Pharmacy Act, 1982, which makes it unlawful for anybody to sell aspirin without the supervision of a qualified pharmacist and is therefore threatening to sue Alien Pharmacy. The Managing Director of Alien Pharmacy has therefore come to see you about the chances of success of Alien Pharmacy, should the matter proceed to court.
