ANSWER THE FOLLOWING QUESTION

Last week, Nora Newdick bought 24 Lower Road, Batley from Arif, the sole registered proprietor. Nora plans to build an extension on the back of the house. To save the cost of employing a solicitor, Nora did her own conveyancing but now she seeks your advice as she has discovered the following problems relating to the property:

  1. Arif's wife and her sister are occupying the house and have refused to move out. They have told Nora that they did not make any sort of financial contribution to the property but believe they each have a right of occupation as they are related to Arif.

  1. Barnstable Bank has written to Nora saying that it lent Arif the money to buy 24 Lower Road five years ago. It says the loan was secured by a charge by deed by way of legal mortgage which is now binding on her as Arif has not repaid what he owed.

  1. Nora has met her next door neighbour, Jonathan, who owns 26 Lower Road. He has told her that he can stop her building an extension as Arif promised, some years ago in a deed, not to alter or extend number 24 in any way before first getting consent from the owner of number 26.

Consider the problems in (i) to (iii) above and explain:

  1. what rights appear to have been created in relation to 24 Lower Road; and

2. whether the rights will be binding on Nora.
