Lauren Cosmetics plc is an Irish company involved in the manufacture and sale of cosmetics including perfumes, aftershaves and natural oils. Last month there was an issue in Lauren Cosmetics store in Sligo, when a young child (who was in the store with their mother) climbed onto a shelf and accidentally caused the shelf containing bottles of oil to collapse. The glass bottles broke on the floor and there was oil and glass all over the floor. Unfortunately, another customer (Denise) who was in the store at this time slipped on this oil and fell. This resulted in her suffering physical injuries including a broken hip and ankle. She has also suffered severe facial injuries from the broken glass. This injured customer has now written to Lauren Cosmetics notifying them that she intends to sue them in negligence for her injuries and for compensation for her loss of earnings. She has indicated that she will require surgery as a result of the injuries to her face and intends to recover these losses from Lauren Cosmetics plc. The managing director of Lauren Cosmetics plc has contacted you for advice. The company are unsure as to whether they have any liability in this situation. The company believes that the accident was a result of the other customer and their child. Required In the context of the Law of Negligence, advise Lauren Cosmetics.
