The plaintiffs were successive tenants of a log cabin owned by a company controlled by the defendant. Lana Weber was the first occupant followed by Ina Lee. One night when Ina Lee was reading in bed, she heard an unusual noise coming from behind her head. Initially, she thought it was a bear grunting or a person quietly clearing his throat. She discovered that a hole had been cut in the wall above her bed, giving a person standing outside a clear view of the room and the bed. The hole was behind a two-way mirror that appeared to be a conventional mirror. Attached to the exterior wall of the bedroom was a small shed. The hole was inside the shed, concealed by a dustpan hanging on a nail. Fibrous insulation was used to plug the hole. The court found the defendant made the peephole. The court awarded Lana Weber $2,000 and Ina Lee $5,000 for damages. Punitive damages of $25,000 were also awarded to the plaintiffs to be divided between them.
