Legally required benefits are certain types of compensation that employers are mandated by law to provide to their employees. (U.S. Bureau of Labor Statistics, n.d.) These benefits are required to ensure the basic welfare of employees, protect them from financial hardship in case of illness, injury, or unemployment, and support them in their retirement years. In general, legally required benefits cannot be waived as they are mandated by law. However, there are certain exceptions. For instance, an employee may choose to waive health insurance coverage if they can provide proof of coverage from another source, such as a spouse's insurance plan. One additional benefit that could be considered for legal requirement is the expansion of health insurance, currently it is only required for companies that have over 50 employees.
