Lisa was 70 years of age and had worked as a waitress her entire life. Lisa had two sons, Mark and John. Mark was a successful restaurant owner. John, her adoptive son from whom she was estranged, lived in a homeless shelter. Jean has had no contact with her estranged husband Paul in years. Mark committed suicide and died intestate. Peter, a lawyer and Lisa's nephew, helped Jean collect all of Mark's estate, which was worth $1 million. Lisa's house is in her name and Peter's name as joint tenants. Grateful for Peter's assistance, Jean made a formal will, naming Peter as her executor and sole beneficiary. Soon after signing that will, Lisa's physical and mental health began to deteriorate. Another nephew, Ed, swooped in and arranged for Jean to have nursing care. Ed convinced Jean to execute a new will, revoking the first will, and naming him as her executor and the sole beneficiary of her estate. Lisa signed this new will in the presence of Ed and her new attorney (not Peter). Right before Lisa signed this new will, she mistakenly referred to Ed as "Mark" (her deceased son), but when Ed reacted, Lisa quickly corrected herself. Many years earlier, Lisa had named another nephew Mike, as the beneficiary on a life insurance policy worth $10,000. Jean dies. Peter contests Jean's second will. John contests both wills and the fact that Lisa received all of Mark's estate.During the trial for the contesting of the will What will Peter argue? What will John argue? What will Ed argue? What will Mike argue? How will the court rule on this case? Provide justification for your decision.
