Lucinda Williams (W) owns a horse, Daisy. Her neighbor, Allison Krause (K) wants to buy it.W operates a stable where she buys and sells horses, boards horses and offers riding lessons. She has never planned to sell Daisy because she thinks of this horse as bringing her good luck.K.'s daughter, Olga, often comes to the stable with K.Olga is very much taken with Daisy. Each week K asks W if she will sell Daisy. Each week K offers more money and W continues to refuse.

Finally, K offers $5,000 and W, being a bit pressed for cash at the moment, agrees to make the sale. They write out a sales agreement specifying that in one-week W will present Daisy and K will bring $5,000.The next day, a Mr. Posner (P) comes to the stable and, upon encountering Daisy, believes that she is the reincarnation of his grandfather. He is tremendously excited and he offers to buy Daisy.W tells him that Daisy has already been sold.P says he will pay five times what the existing deal is.Unable to resist, W agrees. W and P conclude the deal on the spot.W feels a bit guilty, but the money is very welcome.

On the same day as W sells Daisy to P, K commissions Zeb (Z) to erect a small stable on her property. She promises to pay Z $10,000 to build it specifically for Daisy.Z is a well-known craftsman who is much in demand.W is so sincere that he gives up another job to build the stable immediately.

When the week passes, K shows up at the stable with the $5,000.W apologizes but says a much better deal came along, and she offers K. a lifetime of free riding lessons instead of Daisy.K demands Daisy.W says that we all live in a cruel world, and that it is K's fault for waiting a week.K threatens to sue.W is worried so she shows her several other horses, all equivalent in value to Daisy, and offers any one of them plus a free saddle.K adamantly refuses. When she returns home, she sees Z and his men unloading materials from his truck. She storms over and tells him that the deal is off.Z says that it is too late, he is going to build the stable as planned.

Q-5 K comes to your office. She wants to know who she may have claims against, and who may have claims against her.
