Malaysia Land Law Question (Lease & Tenancies)

In 2008, Mickey, the registered proprietor of a two-storey shop house, contracted to grant a 10-year lease of the ground floor to Donald to run an Indian cuisine restaurant business. Even though the contract required Mickey to execute a lease instrument for the purpose of registering a lease, the parties delayed over the matter. Meanwhile Donald entered and took possession of the premises.

Pluto has been planning to carry out a restaurant business in the same locality for long time. He enquired and was told by Mickey that Donald was merely a monthly tenant of the ground floor. He did not seek confirmation from Donald. He then requested Donald to vacate the ground floor within three months. Three months had passed, but Donald refused to leave the premises. Donald believes that has the right to continue running the restaurant business on the premises for the remaining of the 10-year lease. Advise Donald.
