Mariah carried on a consulting business as a sole proprietorship. She met Jackie Johnson at a conference. Jackie told Mariah that she was a "senior lawyer and partner" in a law firm in Toronto. She gave Mariah a business card which had her name on it as well as the name "Johnson, Brown, Riddell and Bastianovich, Lawyers"

Jackie asked Mariah to do some work for the firm.Mariah did the work and sent a bill for $50, 000 to Jackie. While she had been doing the work, Mariah had received several letters from Jackie in paper bearing the Letterhead " Johnson, Brown, Riddell and Bastianovich, Lawyers". Jackie did not pay for the work.

Mariah has sued Jackie along with the other lawyers, Brown, Riddell and Bastianovich.It has just been discovered that Jackie, Brown, Riddell and Bastianovich are not in fact partners.
