Mary tells her friend Brad that she'd be overjoyed if he'd plan her eight year old son's birthday party this year, and would be happy to pay him for his time. Without agreeing to the contract, Brad books performers, orders a cake and gets the invitations printed. Brad tells Mary he's done all of this, and Mary's face turns white. She wasn't serious. She tells him she's sorry but she had changed her mind.
Behind Brad's back, she still uses the performers (they were booked!) and the cake (it was ordered!). Brad finds out and he's miffed. He sues. What's a court to do?
