The house was kind of run-down, but the views were great. They agreed on a price of $200,000 and sealed the deal with a hand shake. Woody paid a deposit of $5,000. Woody agreed to pay Matthew on December 21, and Matthew agreed he would transfer the deed on that date. Woody and his wife could not wait to get started, and with Matthew's permission, they started renovations on the house and cleared some land. On December 10, Matthew and Woody had a disagreement. Matthew refused to sell Woody the land. Woody is heartbroken. He loved that farm. What should Woody do? Woody should sue Matthew for the deposit and the money he spent renovating the house. The agreement to transfer the land is unenforceable, but Matthew shouldn't profit at Woody's expense. Woody should sue Matthew for specific performance. Even though the agreement was verbal, Woody could argue that the part performance doctrine applies and accordingly Woody could enforce the agreement
