Meanwhile, Barney enters into a contract with Rodrigues Racing Footwear (RRF), a
manufacturer of high end running and training shoes, for RRF to supply 20,000 pairs of their
latest model of distance running shoes. Barney intends to sell these, mostly online, to retailers
and individuals in Australia, New Zealand and Canada. There is a good market for this product,
because the shoes are due to arrive just before the start of the Olympics in Japan, and there is
always enormous interest from customers after such a major event. RRF's supplier of the soles
for these shoes, though, is unexpectedly closed due to a fire in the warehouse caused by a crazy
arsonist, and will not be in operation for another six months or even longer. RRF could obtain
soles from another supplier, but they would cost twice the price, which would mean RRF losing
a vast sum of money if it were to fulfil the contract. RRF contacts Barney and explains that,
because of the fire at the supplier, it would be impossible to perform the contract.
Advise Barney whether his contract with the RRF has been frustrated. Use case law to support
your answer.
Note: No research is required for this scenario. Just rely on the course materials on chapter 11
of the textbook (Termination and Breach of a Contract) to answer this question. Do not discuss
any other elements of the law of contract.
