Mia, a 3 rd year GMU student, signed a lease for 12 months to rent an apartment for $1000 a month from her landlord Ann.

Mia, a 3rd year GMU student, signed a lease for 12 months to rent an apartment for $1000 a month from her landlord Ann. In April, Mia finds out that she has been accepted to study abroad at Mason South Korea campus over the summer. At the end of May, Mia decides to lease her apartment to her friend Nev for the 3 months she will be away (from June August). Without seeing the apartment, and after a long night of binge drinking, Nev still intoxicated, meets Mia and they discusses all the material terms of the lease. Nev then signs the lease agreement with Mia that he will sublet her apartment for 3 months at a cost of $1000.00 per month.

Mia flies out for her study abroad program and while away she receives an email from Ann demanding payment because the rent has not been paid. Mia tells Ann that she is not responsible to pay the rent. Mia contacts Nev and finds out that moved out in July. Even though Ann could have rented Mias apartment starting in July for $1000 per month to Imal, she waits until Mia returns from South Korea and files a lawsuit for breach of contract against Mia for $3000.00. Mia also brings a lawsuit against Nev for breach of contract.

#3 What case applies to the (1) Mia v. Nev lawsuit; and (2) the Ann v. Mia lawsuit? In your answer explain why the cases apply. Lastly, what amount of damages (if any) will the court grant Ann?
