Mike, a French national working in the UK for the last six years, is an expert in EU law and, before the pandemic, travelled throughout the EU teaching the importance of understanding MEQRs. Stressed out by 2020, Mike flies to Las Vegas to unwind during a temporary lifting of COVID-19 restrictions in December 2020. Not fully remembering how it happened, Mike finds himself married to Carole, a national of the USA. By the end of his quarantine period in Las Vegas, Mike is very much in love with Carole and they both agree to live together in France. Carole is allowed entry into France for three months as an American citizen. However, when Carole applies for a family visa, the application is denied by the French Ministry of the Interior on the ground that (1) as a French citizen, Mike cannot rely on EU law in France; and (2) in any event, their marriage is one of convenience. Carole is instructed to leave the country within a month. Naturally distressed by this news, Mike remembers his training in EU law and decides to move to Galway, Ireland and find work there. Mike is unclear whether EU law could be relied upon to challenge the two grounds for France's decision to deny Carole a family visa, and if not, whether Carole would be entitled under EU law to work and reside with him in Galway without any conditions.
