Miles is a recent graduate of the University of the Central Okanagan School of Business, with a major in real estate development. He wants to assemble land near the University in order to build high-density housing for married students. He approaches Randy, a well-known realtor, who agrees to find the land for him in return for Miles' agreement that he will pay a commission to Randy of 10% of the purchase price of any land acquired due to Randy's efforts. A week later Randy contacts Miles to say that he has a property for him, priced within Miles' stated budget. The seller is a numbered company. Miles agrees to do the deal and Randy receives his commission. Some time later, Miles learns that the numbered company from whom he bought the property does regular business with Randy and that Randy received a further 10% commission from the numbered company on the sale of the property to Miles.
