Min Patel appliced for a postion as a Deputy Sheriff with her County's Sheriff's Department. She was please to learn that she had passed all the exams and that the Department wanted to hire her. She would have the job if she passed the medical exam.
During her medical exam, when questioned about her medical history, Min explained that she had lung cancer three years ealier but was in complete remission. Otherwise, she checked out fine. The Department informed her that she could not be employeed because she did not pas her medical exam.
Min filed a complaint saying that she was discriminated agains based on a paste medical condition which was no longer a factor. The County responsed that there was a possibility the cancer could return and that as a Deputy Sheriff, Min would be exposed to situations where she could be breathing substances that could reactivate her condition.
