Minna persuaded her daughter Christel to become a law student by promising to support her during her studies. Christel agreed. Minna then bought a beautiful big house with seven bedrooms in the city near the university where Christel was studying and promised that she could: (i) live rent free, and (ii) collect rent from other tenants that lived in the house. Christel rented four of the bedrooms out and was doing very well at school. However, after her second year in a three year program her mother got in a terrible fight with her because Christel would not come home for the summer holidays. Minna tried to claim possession of the property while Christel was still studying.
Christel has retained you as her lawyer. Please advise Christel, if there is an enforceable contract with her mother? Also, discuss if there is a problem because they are not arms length i.e. mother and daughter. If there is a contract, is Christel entitled to occupy the premises for as long as she likes? Explain your answer.
