Mr. Ali borrowed RM 30,000 from Mr. Halim. He however, is unable to pay the debt. His daughter on behalf of her father, signed a cheque worth RM 20,000 to Mr. Halim in full satisfaction of the debt. She also mentioned, if Mr. Halim refused to accept her condition, he has to return the cheque back to her. After a wee, Mr. Halim cashed the cheque and pursue Mr. Ali for the balance. Mr. Ali refused to pay, Mr. Halim then proceed to issue bankruptcy notice on Mr. Ali. Advice Mr. Ali on a possible defence.
