Mr. Anderson, an educated successful businessman, went to the local horse races where he ran into a, Mr. Baldwin, a friend and recent immigrant from the country of Schitts Creek who spoke limited English, was poor and had a Grade 7 education. They each spent an equal amount of money on the "sweep six" which meant if the winning horse was picked in all 6 races that it would pay a lot of money. They decided to pool their tickets and to share equally any winnings. One of Anderson' tickets won the sweep 6 with $800,000 in winnings. That meant he was to pay $400,000 to Baldwin. Anderson delayed paying the Baldwin. Baldwin heard that Anderson was talking about moving to the U.S. Baldwin had no money to hire a lawyer. When Anderson offered to pay him $100,000 and no more Baldwin took it, hired a lawyer and sued for the remaining $300,000.
