Mr B institutes divorce proceedings against Mrs B. They both enter into a settlement agreement which states that Mrs B will pay Mr B R300 000, 50% of which will come from her pension fund. In return, they agree that Mr B will transfer their house to Mrs B. On 5 August 2021, the divorce is finalised, and the divorce decree is granted. As per the settlement agreement, Mr B transfers the house into Mrs B's name. However, Mrs B refuses to transfer the 50% of the pension fund amount to Mr B. Mr B is unhappy because Mrs B has breached their agreement. He then approaches you, his lawyer, as he intends on applying for a court order forcing Mrs B to pay the pension fund amount to him.
