Mr Henry recently started a farm in Tobago and sent his 3 pigs by boat. He would then collect them at the port at Tobago. He travelled by air. The boat was delayed and the pigs arrived late at night. Mr Henry was not present to collect them and the ship owners paid for the pigs to be kept overnight. Mr Henry failed to collect them on the following morning. The only basis on which he was prepared to give any instructions about the his pigs was that the ship owners assumed all responsibility for storing and delivering it to him from the time of its arrival at Tobago. After two weeks of this, the ship owners delivered the pigs to Mr Henrys farm and then sued him for the upkeep of the pigs from their arrival in Tobago to the date they were delivered to his farm.
