Ms. Claire Fernandes wanted to purchase a Bungalow and the adjoining garden from Mr. Mohil Sidhu. 2. They conducted initial discussions and had agreed on a final consideration amount. Out of the said amount, Ms. Fernandes paid a token amount of Rs. 10,00,000/- and promised to pay the balance amount within two months, at the time of execution of the sale deed. 3. After the expiry of two months, a sale deed was drafted and Mr. Sidhu requested Ms. Fernandes to pay the balance amount. Ms. Fernandes refused. She stated that she did not want to proceed with the transaction as she had received credible information through her friend that the said bungalow had been used as collateral in order to raise money for the business activities of Mr. Sidhu. 4. Ms. Fernandes has sought a refund of the amount already paid. Mr. Sidhu refused the refund and wants to proceed with the sale. 5.
