Ms. Janet Sinclair was employed by Upham Co. In January, 2006, her supervisor told her to dispense 1,000 gallons of a certain liquid in a nearby stream. Ms. Sinclair objected to her supervisor's request and refused to dump the liquid in the stream. A week later she was discharged. In March 2007, Ms. Sinclair (still unemployed) applied for a job with Goetz, Inc. and had to list former employers as references. The only employer Ms. Sinclair listed was Upham Co. Ms. Sinclair was not hired by Goetz and when she asked why, she was told "we didn't like your references."

Based on these facts Ms. Sinclair decides to sue: (a) What are the possible claims she might raise (Hint: there might be more than one claim here)? For each claim, please be as explicit as you can, explaining the underlying theory as fully as possible. (b) Discuss any possible defenses to Sinclair's claims (c) What additional information would you need in order to determine whether or not Ms. Sinclair would prevail on each claim. Do not assume anything, and you need not decide anything. Just tell me what additional information you would need if you were asked to decide the case.
