Nancy and Joan were employees of Hancock Mutual Life Insurance ("Hancock") for 12 and 2 years, respectively, until their termination in July 2020 after Hancock discovered that they had been forwarding sexually explicit e-mails from third parties, including Nancy's husband, to yheir coworkers. Hancock found that Nancy and Joan had violated the company e-mail policy, which prohibited certain content and maintained that management had a right to access all of an employee's e-mail files. Hancock had periodically reminded its workers of the e-mail policy and also provided examples of employees who had been disciplined for violations. After being terminated, Nancy and Joan brought an action against Hancock, claiming in part that Hancock had invaded their privacy. Specifically, Nancy and Joan contended that Hancock had created a reasonable expectation of privacy for personal correspondence sent using company e-mail because Hancock had instructed Nancy and Joan on the creation of personal passwords and private folders.
