Notice of Deposition

You are the paralegal for William Sharp. As you know, he represents Susan Smith. He wants to take the deposition of James Devo, the plaintiff's employer. Draft a Notice of Intent to Take Oral Deposition and Rule 45, FRCP, subpoena for Mr. Devo. The deposition will take place on October 30, 20323 at 9:00 am at Mr. Sharp's office. The deposition will be recorded by stenograph and videotape. Use Form AO 88A (Rev. 02/14) Subpoena to Testify at a Deposition in a Civil Action, located on the US court website at http://www.uscourts.gov. No documents will be requested of this witness.

Remember to include the following:

• Notice to all appropriate persons and/or entities
• Determine the witness fee. Assume James Devo's round trip car fare to/from the deposition is 33 miles. Hint: research required.
• Type both documents; no handwritten documents. You may use the subpoena form but you will have to transfer the caption and type information onto the form
• Certificate of service.
