Dear Lisa,
We are pleased to offer you the full-time position of Health and Safety Coordinator with WellMart. The effective date of your appointment is March 15, 2021.
1. Conditions of Employment
The terms and conditions of your employment are outlined below. This employment contract will be governed by established Well-Mart policies and procedures, and in accordance with all applicable employment laws in the province of Ontario, except where you and the employer have agreed, either electronically or in writing, to waive specific entitlements imposed by the legislation.
This contract may be modified or changed in whole or in part, but all such changes or modifications must be agreed to and shall not take effect until they are in writing and signed by both parties.
2. Probationary Period
This employment contract is subject to a three-month probationary period from your date of hire, during which time the employer may, in its discretion, terminate your employment without any notice or pay in lieu of notice.
3. Payment of Wages
Your annual salary for this position is $56,000. All wages will be paid on the 1st and the 15th of each month and will be deposited directly into your bank account. Statutory deductions will be made in accordance with applicable laws, and a statement of payment and all deductions will be provided to you at the end of each calendar year.
4. Hours of Work, Overtime
Your regular hours of work shall be Monday to Saturday from 9 a.m. to 5 p.m., inclusive of a one-hour unpaid lunch break. You will receive every Sunday off plus one additional day off per week. There may be times when you are required to work overtime; however, as a salaried employee, you are not entitled to overtime pay or time off in-lieu, as your salary is deemed to cover all hours that you are required to work in a workweek or pay period.
5. Vacation with pay
You will be entitled to two weeks' vacation time with 4% vacation pay after the completion of 12 months of employment. Vacation time may be taken at a time agreed upon by the employer. After five years of employment, your vacation entitlement will increase to three weeks' vacation time at 6% pay.
6. Accommodation
Should any accommodation be required by you in order to make your job accessible due to disability, such as documents in digital form or real-time captioning at meetings, workstation accommodations such as a raised deck, or automatic doors or accessible washrooms, you are responsible for initiating such arrangements and any related cost.
7. Termination
Following completion of the probationary period, the employer may terminate your employment under this agreement for any reason, without cause, upon providing you with notice of termination as set out in the applicable legislation, or provide pay in lieu of notice, plus all other payments or entitlements to which you are entitled under the applicable Ontario statute.
Should you terminate your employment, you are required to provide the employer with a minimum of five (5) working days advance notice in writing, in accordance with applicable legislation.
Please indicate your agreement to these terms by signing below and returning the original to the store manager at your earliest convenience.
