Bart saw the advertisement and went to the store. Bart said to Ruth, the Best Buys sales manager, I accept the offer of the TV for $1,000, here is my card for payment. Ruth told Bart that there had been a rush on the TVs, and they had sold out of the advertised special offer. Bart insisted he had a contract based on the advertisement. Ruth said that was not correct and offered another TV on special, 75-inch Sunny Smart TV, 2021 model for $1,000. Ruth said this was also a good deal. Bart was unsure if he wanted the Sunny TV. Ruth said he could think about the Sunny TV overnight and advise Ruth tomorrow, 2nd May by 12.00pm if he wanted the Sunny TV. Ruth would hold the Sunny TV for Bart. Bart gave Ruth his mobile number and email address. The next day, 2nd May, at 9.00am, James came into the store, saw the 75-inch Sunny Smart TV, 2021 model for $1,000 and told Ruth he wanted to buy the Sunny TV. Ruth sold the Sunny TV to James. Ruth rang Bart to advise that the Sunny TV had been sold. Bart did not answer his phone and Ruth left a message. Ruth also emailed Bart advising of the sale of the Sunny TV. At 10.00am Bart listened to the message left by Ruth on his phone. He was very upset as he had decided to buy the Sunny TV. Bart rang Ruth back. He told Ruth that he wanted to buy the Sunny TV for $1,000 and she should not have sold the Sunny TV until after 12.00pm. A. Identify the legal consequences of all communications with reference to decided cases and advise Bart of his contractual position with Best Buys. B.
