On a separate piece of paper, please answer the following questions. Please note that I am more interested in your analysis than I am your conclusion. Specifically, I am looking for you to identify the issue, identify and discuss the rule(s) of law and then applying the facts of the case to the rule(s) of law to reach a conclusion. More weight will be given your argument supporting your conclusion than to the conclusion itself.

1. Profit Corporation authorized Anderson, an employee, to find a buyer for used equipment that Profit intended to sell. Anderson was given a standard form contract to use for the sale, and instructed not to change any of the terms and conditions of the contract. Anderson found a prospective buyer, Caveat Corporation, and contracted with Caveat on behalf of Profit for the sale of the equipment to Caveat.

In this contract, Anderson added a provision that warranted that the equipment was fit for Caveats particular needs. A responsible officer of Profit read the contract and directed that the equipment be shipped to Caveat. The equipment did not meet the special needs of Caveat, and Caveat refused to pay for it. Profit sued Caveat for the contract price. What legal arguments will each side make. What is the likely outcome of this case and why?
