On Friday, Art spent the morning looking for a used boat online on Kijiji. He discovered one that
caught his attention. The posted ad had pictures and detailed specifications and it noted the
selling price at $19,000. Firm.
Art emailed the boats owner and made arrangements to see the boat the following day at 10:00
am.
Art arrived, met the owner, and thoroughly checked out the boat. It was as described. But Art
said that he needed to reflect on it over a coffee at Tim's and would return. He surprised the
owner by giving him $500. cash and saying - "I'll be back. We'll make a deal". The owner was in
awe and said nothing.
An hour later, he called the owner and said that it was a lot of money at $19,000. but that he
would take it that day for $18,000. cash and Art confirmed that he had the funds with him.
The owner responded by saying that there were two other interested parties who were there and
viewing the boat at that instance. The owner told Art - "Things are happening fast. You might
want to get back here".
Art panicked. He quickly drove back. He noticed the owner intensely engaged with a prospective
purchaser. Art interrupted and reached out, took the owners hand, shook it, and said Ill take
it for the $19,000. advertised on Kijiji and the $19,000. you still wanted when I saw the boat and
met with you just over an hour ago and Ill pay you cash right now.
The owner says to Art Well this other gentleman just now offered me $18,000. and hes a
fine man and I feel good about doing a deal with him and that he will care for the boat as I
always have. Then turning to the other man of whom he spoke, the owner said O.K. we have
a deal at $18,000..
Art is upset and now hes showing it. Art says Well thats the number I told you over the
phone. I want the boat. Im entitled to the boat. I agreed to take it for the full ad price of $19,000.
and I told you so and shook your hand before you agreed to sell it to the other guy. I even gave
you a $500. deposit.
Art, the owner, and the other guy who believes that he just bought a boat are all standing there
in an awkward silence trying to figure out what to do.
Help them out. Reviewing the facts, the chronology of events, and the law on contracts come to
