On July 15th, Jack borrows $100,000.00 from National Capital Bank to buy a house. Jack signs a promissory note and a mortgage to National Capital Bank as evidence that National Capital Bank loaned Jack the money. Jack's first payment is to be made by September 1st. Before Jack makes his first payment on the note, National Capital Bank, on July 31st, assigns all of its rights to XYZ Co. Both National Capital Bank and XYZ Co. give notice of the assignment to Jack, and Jack receives that notice on August 10th. XYZ Co. on August 28th then assigns all of its rights to State Mortgage Company, but doesn't send to Jack notice of the assignment to State Mortgage Company. Jack mails his first payment on September 1st. To whom does Jack send the payment?

The choices are

a. National capital Bank

b. XYZ Co

c. State Mortgage Company

d. none of these because mortgages cannot be assigned.

I think the correct choice is the last one ( is that correct)

This is Part B

Change the facts in #41 above so that Jack receives notice from both XYZ Co. and State Mortgage Company of the assignment by XYZ Co. to State Mortgage Company before Jack sends his first payment. To whom does Jack send the payment?

The choices are

a. National capital Bank

b. XYZ Co

c. State Mortgage Company

d. None of the above, because a right that has been assigned once cannot be assigned again.

Again, I think it is the last option choice d please let me know if this is correct. Thank you
