On or about 10th September 2018, as a member of the academic staff of a Caribbean University by your collective verbal statements, you caused personal discomfort of a sexual nature to a student, after offering her a lift/ride to a restaurant downtown to buy something to eat, then asking: do you have your visa and do you have a boyfriend and by stating that she is a very beautiful girl and you did not want anyone to spoil her and that you wanted to take her for lunch sometime and that she was very beautiful.

On or about 10 September 2018, whilst offering the young lady the lift /ride as described above, you misconducted yourself as a member of the academic staff of the University by touching her without her consent in a sexual manner by caressing her right knee with your left hand, causing her to push away your hand.

A few weeks later, the lecturer sent pictures of himself to the named student without her consent and sent videos and pictures of himself from his personal cell phone without her permission; Having regard to the facts and circumstances as alleged above, as a member of the academic staff, you breached the Universitys policy against sexual harassment.

ACTIVITY

Answer/address the following issues.

1. What is sexual harassment?

2. What different forms can sexual harassment take? Discuss the issues presented in the case to determine if the actions by the lecturer can be classified as sexual harassment.

3. If you determine that it is sexual harassment, how should the employer deal with the matter? Explain fully the steps suggested citing legal cases to support your position. If you determine that it is not sexual harassment, clearly give your rationale and state how the employer should deal with the matter, citing legal cases to support your position.

4. Make recommendations to the university for dealing with any similar issue that may arise in the future.

5. Suppose the above scenario involved a male lecturer and a male student, how would you have argued? Discuss and give reasoned explanation for your position.
