On September 1, 2020, Susan (age 60) signs a written agreement with

Ricardo, in which she agrees to sell her house to Ricardo for $250,000.

Ricardo promises to pay Susan $5,000 by September 10, 2020, and the

balance of the purchase price by September 30, 2020. Ricardo makes the

payment of $5,000 on September 10, as promised. When Susan tells her

children (on September 15) what she has done, they tell her that she

should have gotten an estimate of value from a broker or appraiser before

agreeing to sell. Susan then talks to an appraiser, who lets Susan know

that the house is worth about $350,000 in today's market, even though it is

tiny and not in very good shape. On September 20, Susan sends Ricardo

an email in which she says: "Sorry, Ricardo, I have changed my mind

about selling my house just now. I am returning the $5,000 you sent me."

Does Ricardo have any legal rights?

a. No, Susan has the right to change her mind anytime prior to the completion of

the sale.

b. No, Susan can cancel the agreement, because Ricardo has not paid Susan

the full amount yet.
