On September 5, 2023, Greg, a fur coat merchant, offers to sell Henry, a fur coat retailer, 20 ladies fur coats at $ 2,000 per coat. Gregs written offer clearly states The deadline for accepting this offer is 12 noon on September 20, 2023. Please discuss each of the following with reasons for your conclusions.

  • Suppose that Henry sends Greg an acceptance on September 10, 2023 which Greg receives on September 21, 2023. Greg immediately declares that Henrys acceptance is late and refuses to provide Henry with the coats as offered. Does Henry have a valid claim here? Why or why not?

  • Suppose instead that Greg promises in writing to keep the above offer open until January 6, 2024 but, when Henry shows up on December 3rd to accept the offer, Greg informs him that he has already sold the coats to Stevens. Does Henry have a valid claim in such a case? Why or why not?

  • Suppose instead that Henry accepts the above offer in writing but then backs out of the deal forcing Greg to sell the coats to another buyer for $ 1,500 per coat. Does Greg have any valid claim against Henry based on these facts? Why or why not?

  • Suppose that Henry tries to back out of the deal so Greg seeks court orders to force Henry to supply the coats as well as to prevent Henry from selling any fur coats to anyone for three months. Will Gregs efforts succeed? Why or why not?
