On Tuesday March 1, Stewart posted a letter to his friend Mark, who lives in Montego Bay informing him that he is selling his classic car for $3,000,000 and he is to send his response as to whether he will purchase the car in the course of post to his work address which is 245A Mona Lisa Drive no later than Tuesday March 8. Mark received the letter on Thursday March 3 and immediately called Stewart and left a message on his phone that he would come with the cheque for $3,000,000.00 and collect the car on Thursday March 10. Stewart did not check his phone messages and as he expected to receive a response from Mark no later than Tuesday March 8, he sold the car to another friend Jack for $3,500,000.00 on Wednesday March 9. Mark arrived on Thursday with the cheque, as he said he would in the telephone message he left, along with another driver to take the car back to Montego Bay. Stewart informed him that he sold the classic car the previous day, as he did not receive a response from him. Mark informed Stewart that he was going to sue him as he accepted his offer when he left the message on the phone. Stewart has come to you for advice as to whether or not Mark is correct.
