Orlandobuilds himself a garden shed. He drives posts into the ground, puts a timber platform

on top of the piles and attaches a shed to it that he bought atMitre10, a prefabricated

aluminiumshed, which he screws down to the timber platform? His next doorneighboursthe

Schmiedswatch all of this with interest. He finishes the shed on Sunday evening and goes to

work Monday morning. He gets home late on Monday to find that theSchmiedshave had a

fence built between their respective properties and the shed is on theSchmieds'side of the

fence.Orlandovisits theSchmiedson Tuesday to ask about the fence. They tellOrlandothey

had their property surveyed and the shed is on their property [this is correct]. They knew this

whenOrlandostartedbuilding the shed but waited to see what he was doing.On Wednesday

while theSchmiedsare out,Orlandoclimbs over the fence, dismantles the shed and throws it

all over his side of the fence. He leaves the posts behind. When theSchmiedsdiscover this

they are furious and make a claim in the Disputes Tribunal for compensation for the stolen
