Our client, Mr. Nguyen, was arrested three weeks ago under the following circumstances: Mr. Nguyen rents one-half of a duplex on North 15th Street. Apparently, Mr. Nguyen's residence was under surveillance for several days prior to the arrest that took place three weeks ago. The police received a tip that large numbers of automatic weapons were being sold out of Mr. Nguyen's residence.
The officers believe that the sale and purchase of the weapons is gang related. A search warrant was obtained for the residence several hours prior to the arrest. Two uniformed officers, armed with a properly executed search warrant, approached the residence while other officers positioned themselves around the duplex. As the officers stepped onto the porch, Mr. Nguyen's brother opened the front door; upon seeing the officers, he began to yell over his shoulder and retreated into the home.
Without announcing their intent or purpose, five officers rushed the doors of the duplex at that time. The front and back doors were broken down and the officers entered the duplex. Many weapons were seized and our client was arrested.
