Part 1: Application of the Consumer Guarantees Act 1993

Instructions for Part 1: The lecturer and workshop tutor will walk you through this ILAC. This is a demonstration on how to construct an ILAC. Make sure you attend lectures and workshops. Your job is to write down the Law, Application, and Conclusion sections in good English.

Scenario: Janet bought a new washing machine from HCO Supplies Ltd. It was installed in her apartment. After using the washing machine for a week, she observed that some of her clothes would still be dirty after the completion of a washing cycle. The machine was also very hot to the touch after use. In the second week, the washing machine exploded during the washing cycle. Janet had to call to the fire service; her clothes and the machine were burnt beyond repair.

Janet phoned HCO Supplies Ltd. and demanded a refund. Jim, the manager, told Janet that there was a "No refunds" sign in the shop. Thus, HCO Supplies Ltd. was not obliged to offer her any remedies. Janet did remember seeing the sign.

Janet is not familiar with the Consumer Guarantees Act 1993. She comes to you for advice. She is particularly worried about whether she has any basis for any claim against HCO Supplies Ltd. She wonders whether her inability to return the washing machine will impact on her claim and whether the notice in Jim's shop excludes her from any remedies.
