Part A: Fact-based response: (200-250 words max) Presuming Pawstate's disability laws for service animals coincide with the ADA (42 U.S.C. 12131- 65(2021), please answer the following: 1. was Mr. lamada correct that HappyBoy and Sugar could remain in the dining room because both dogs are service dogs under the ADA? Why/Why Not? What more might you want to know to answer the questions, if anything? What documentation does Mrs. lamada need to provide (if any) to Mr. Chef demonstrating that she has a disability and the dogs are professionally trained under the ADA? Consider what questions Mr. Chef can ask to verify Mrs. lamada claims. . Is Mr. Chef obligated to honor Mrs. Mommy's complaint and demands that both HappyBoy and Sugar be removed due to Mrs. Mommy's daughter's severe allergies and phobias to dog dander and large dogs under the ADA? Why/Why Not? Please identify three other issues in the scenario that stand out as being authorized or not authorized under the ADA and provide a reference to the materials or cases you read that might apply. Part B: Informed Opinion response (200-250 words max): Presume you are the district representative for the state where Mrs. Mommy, Mrs. lamada and Mr. Chef reside. After the restaurant incident, you receive a visit from each of them independently. All three are demanding that you support their contention that the state law must be adjusted to avoid a future similar incident. Mr. Chef and Mrs. Mommy request that the civil rights law under Happystate, USA be amended to weed out unscrupulous requests for accommodations. They demand that the law require detailed inquiries and evidence from a medical professional attesting to the fact the person is disabled, and disclosing the nature of the person's disability as evidenced by attestation from a medical provider. They also want evidence that the animal in question is properly trained and certified by a reputable professional to behave in a public setting in a way that will not jeopardize public safety. Mrs. Mommy also wants the law to indicate that if there is a conflict between the person with the disabilitys' desire to occupy an establishment with a service animal, and a non- disabled person with a severe phobia or allergy to the service animal, the proprietor will minimally place the service animal away from the non- disabled patron. Mrs. lamada learns about Mr. Chef's & Mrs. Mommy''s requests and urges you to ignore them. Your subcommittee is meeting tomorrow. Which position will you recommend? If you are advocating for documentation and/or evidence of training beyond what the law currently allows, indicate the types of proof that you would find acceptable, and under what circumstances a person might be required to provide it. If you believe based upon the conflicts and resolutions raised in the materials and cases that more evidence or more invasive inquiries are not justified explain why you think so. Be sure to incorporate references to this weeks' materials in your response. You may, (but do not have to) include outside sources. You are not being graded on the 'right' answer--but on the thought process--what you would want to consider or know based on the examples you've seen in the readings . Also consider the counter-argument to your position and how you would address the concerns. Contemplate the impacts on the disabled person and the system overall. What concerns might be raised? How do you justify the benefits/burdens for all key interested parties? *For the sake of this exercise, presume that a national registry could be established that would certify the credentials of the animal trainers and the dogs' ability to meet the required standards of behavior. The mechanics and logistics and feasibility of such standards are beyond the scope of the exercise and should not be addressed in your response
