Part I - Short Answer Essay Questions Facts: Tom James ("James") works as a vice-president ("VP") at Epic Retail Store ("Epic"). James is 55 years old and has worked at Epic for 22 years. Julie Keller ("Keller") previously worked as a clothing buyer for Epic. Keller's boss, Bud Schillo ("Schillo"), was a Director at Epic and reported to James. In August 2010, James, Keller, Schillo and a team of other clothing buyers attended a three- day convention in New York City ("NYC"). At the end of each day, the entire Epic team would meet for dinner and drinks in the hotel bar. On the second night of the convention, several members of the Epic team got somewhat inebriated, including Keller and James. It appeared to some Epic team members that Keller and James were flirting with one another in the bar. At the time, James was divorced but Keller was married. Around 11 p.m., James paid the entire bar tab and told the remaining four Epic employees (including Keller) that he was turning in for the evening. Two of the remaining employees observed James and Keller have a short but friendly conversation before James left the bar. About fifteen minutes after James left, Keller told the remaining Epic employees who were still in the bar that she was going to bed. After Keller left the bar she went to James's hotel room and knocked on the door. James did not have a shirt on when he opened the room door. Keller entered the hotel room and she and James briefly talked about work issues before James approached Keller and began kissing her. Keller initially reciprocated James's affection, but after awhile Keller pushed away and said she can't do this because she's married. James apologized and said he understood. Keller then stood up and left James's hotel room. The next morning before the convention started, James saw Keller in the hotel lobby. As James approached Keller he began saying, "About last night .." when Keller cut him off and said, "Don't worry about it, we've got a lot of work to do today." They did not have any further discussion about the hotel room incident. In February 2011 (6 months after the NYC convention), Keller told her boss, Schillo, that she was resigning. Keller said the job was stressing her out and she needed to spend more time with her family. Schillo was surprised by Keller's abrupt resignation because she had always been an excellent employee and buyer. However, Schillo had noticed that Keller's mood and demeanor had seemed different since the NYC convention
