Paul Patton lives in a condominium located in Applewood, California. The condominium complex consists of 200 units. In the middle of the complex there is a community pool and jacuzzi, tennis courts, playground and gym. Paul is a truck driver and has been a truck driver for over ten (10) years. The long road trips have caused him to suffer from continuous back pain. When he gets home from work, he likes to use the jacuzzi in the condominium complex. He has used the jacuzzi on numerous occasions since 2015 when he purchased his unit. On October 25, 2023, Paul had come home from a five (5) day work-related road trip. Paul's back was bothering him, so he decided to use the jacuzzi. When he arrived at the jacuzzi, another resident, Jessica, was there and getting ready to go into the jacuzzi. Paul and Jessica are neighbors and they started to engage in small talk. While they were talking and walking toward the jacuzzi, they noticed a strong smell of chlorine. Jessica asked Paul if he smelled the chlorine. Paul stated that he did, and told Jessica, "Yes, I smell it...the HOA probably hired a new pool company who overchlorinated the pool....this has happened before." Paul then sat on the edge of the jacuzzi and put his legs in while he was still speaking with Jessica. The chlorine smell was now overwhelming to both Paul and Jessica. Paul then began to experience excruciating pain in both of his legs. He pulled both legs out from the water and both he and Jessica were shocked to see that Paul's legs were badly burned. Paul was unable to stand. Paul directed Jessica to call 911. After Jessica called 911, she soaked a towel in clean water and covered Paul's legs. The paramedics arrived and rushed Paul to the hospital. The emergency room doctor diagnosed Paul with having second-degree and third-degree chemical burns to both legs. As a result of the burns, Paul was hospitalized for four (4) weeks and underwent numerous skin grafts. He then had to undergo rehabilitation for three (3) months. During that time, he was unable to work. After Paul's accident, the HOA conducted an investigation with their pool service company and a pool parts expert, where it was determined that the chlorinator for the jacuzzi had malfunctioned causing a dangerous level of chlorine to enter the jacuzzi. The pool service company, Blake's Commercial Pool Service, installed the new chlorinator on October 23, 2023. It was determined that the chlorinator was installed properly, but that a component part, the automatic feeder flow indicator, had failed which was also determined to be due to a manufacturing defect as opposed to a design defect. The chlorinator was manufactured by Hydrotech, Corp., a California corporation with its principle place of business in Nutley, California. Paul is contemplating filing a lawsuit against Hydrotech Corp.
