Peace and Ashley are next door neighbours on Grange Ave. For some time, Peace has suffered from mental health issues, involving depression and paranoia. One evening Ashley notices that Peace's front door is open and fearing something might be wrong, he calls the police and requests a 'wellness check' for Peace. The call handler contacts the nearest car being driven by PC Darton and PC Oakely. The call is given a low priority and it takes PCs Darton and Oakley an hour before they respond to the call. When they enter the home, PC Darton announces that 'it's the police! If anyone is inside, make yourself known!' Peace opens her bedroom door startling PC Darton who then fires his taser gun. She screams and falls to the floor, at which point PCs Darton and Oakley find that she has died.

Next door, Ashley hears Peace scream, followed by PCs Darton and Oakley yelling. Ashley knows something has gone wrong, but fearing for his own safety he remains in his home. Soon after, Ashley hears sirens and witnesses the coroner removing Peace's body. Four months on, Ashley now suffers from uncontrollable flashbacks of the incident and suffers from night terrors.

Further down Grange Ave, Gemma lives with her two children: Charlotte (17yrs) and Cole (13 yrs). For the last year and a half, Birmingham City Council had assigned Marisa, a social worker, to their home after they received calls from neighbours that Gemma had been abusing Charlotte and Cole. Marisa herself had documented instances where suspicious bruises had been found on Cole's arm. Unfortunately, Birmingham City Council has no beds available at the time to take both children into care. Concern was also expressed over Charlotte's age and the complexity of taking teenagers into foster care. At one of their meetings, Marisa mentions to Charlotte that she 'just needs to stick it out a little longer and they'll take care of things. We'll put you in contact with some women's shelters so that when you turn 18, you can get out of here.' One week before her 18th birthday, Charlotte and Gemma get into an argument and Gemma pushes her down the stairs of their home. Charlotte sustains a fractured back and a broken ankle.

How and what would I advise all parties as to their rights and liabilities in tort.
