PEAR Executive Search Inc. wishes to employ a recruiter to do Executive Director searches. The duties of the employee would include soliciting and securing job orders for executive directors from nonprofit corporations and other company clients (job orders), recruiting and placing candidates with those client companies (placements). The employee will be called upon to perform other tasks/duties when needed and as determined by the company. It is expected that the employee will secure a minimum of one job order a month.With respect to compensation. PEAR wants to pay the employee on a commission basis only. The commission would only be paid after a placement has been made by the employee and PEAR has been paid by the company for the placement. The commission would be 12.5% of what PEAR received for the placement. PEAR also wants to retain the right to pay all, a portion, or none of the commission with its decision-making power to be final.PEAR will not provide any benefits beyond what is required by state law. PEAR desires that the employment relationship be "At Will". The employee will have access to PEAR'S confidential records and client data base. PEAR does not want the employee to disclose or use any of the information from those confidential records or data base after the employee leaves or is terminated by PEAR.
